Infinity Brands S. de R.L. de C.V., referred to as "INFINITY BRANDS", located at Calle Tomás V. Gómez 182, Ladrón de Guevara, C.P. 44600 Guadalajara, Jalisco, Mexico, Tax ID SBR210621E48, hereby makes available the terms and conditions under which the use of the website www.infinitybrands.mx and its electronic application ("website") will be governed. Therefore, any person who uses the website or purchases products from INFINITY BRANDS (hereinafter "User") must adhere to the provisions herein.

The Data Controller issues this Privacy Notice so that the data subject, hereinafter referred to as "Data Subject", is aware of how the Controller processes their Personal Data, through any means and particularly in relation to the website www.infinitybrands.mx, hereinafter, the "Website" or the "Site".

Personal Data We Collect:

 

The Data Controller collects the following Personal Data from Data Subjects: identification data, fiscal data, heritage data, and contact data. The Controller may request that the Data Subject verifies the data provided and indicates their preferences regarding marketing communications.

Purposes of Personal Data Processing:

 

The Controller processes the Data Subject's Personal Data to fulfill the following purposes:

 

(i) Original Purposes: Provision of services and products offered by the Controller to the general public; processing requests made by the Data Subject regarding services and products offered by the Controller, potentially resulting in a contractual relationship; fulfilling the rights and obligations of the parties in the contractual relationship they maintain; ensuring the security of the client's operation and identity; integrating an identification and knowledge record in compliance with applicable provisions; collecting personal data to resolve queries, complaints, or claims; using data for measurements to offer, improve, and promote products and services; providing information of interest to the Data Subject—all of the above purposes are essential for the establishment of the Legal Relationship.

 

(ii) Secondary Purposes: Used for statistical purposes, offering, improving, and promoting products and services, as well as providing information of interest to the Data Subject. If you do not want your data to be processed for Secondary Purposes, please send an email with the subject "Refusal of Secondary Purposes" to info@infinitybrands.mx.

Transfer of Personal Information and Personal Data: The Controller may transfer the data of the data subject to a national third party corresponding to the logistics, financial, and anti-fraud sectors for the purposes of providing the services and products offered by the Controller to the general public; processing requests made by the Data Subject regarding services and products offered by the Controller, potentially resulting in a contractual relationship; fulfilling the rights and obligations of the parties in the contractual relationship they maintain. However, it is emphasized that the aforementioned third parties can only use this information to fulfill the purposes expressed for each one. Likewise, given that all the aforementioned purposes are to fulfill original purposes, it will not be necessary to obtain consent for the transfer, in terms of Articles 36 and 37 of the Personal Data Protection Law held by Individuals.

Exercise of ARCO Rights:

 

The Data Subject has the right, in person or through a Representative, to request Access, Rectification, Cancellation, or Opposition at any time regarding the personal data processed by the Controller. To do so, the Data Subject must send a written request via email with the following Requirements:

 

(i) The name of the data subject, address, and email address to communicate the response to the request.

 

(ii) Identity documents, including voter ID, passport, military service card, or migration card, attached as a clear and legible image of both sides.

 

(iii) If represented by a third party, include identification of the representative and a power of attorney signed by two witnesses acting on behalf of the data subject, with clear and legible images attached.

 

(iv) Description of the relationship with the Controller.

 

(v) Clear and precise description of the personal data for which they seek to exercise any of the rights of access, rectification, cancellation, or opposition to them.

 

(vi) In case of modifications to be made, provide supporting documentation for the request.

 

(vii) The letter must be addressed to the Controller and the Privacy Area of the Controller. The request will be sent to the email address of the Personal Data Area at info@infinitybrands.mx.

The Controller will communicate to the Data Subject, within 20 business days from the date of receipt of the request for access, rectification, cancellation, or opposition, the determination made to the same email indicated. The moment the Controller receives the request is when it enters our server, responding with an Acknowledgment of Receipt. Once the response is sent within the specified period, the Controller will have 15 business days to execute the Access, Rectification, Cancellation, or Opposition of the personal data in accordance with the request. The response, and if applicable, the information will be sent via email. If the Data Subject so decides and if applicable, the information will be sent to the medium indicated for such purposes by the Data Subject, provided that they request it and pay the justified or justifiable shipping costs or reproduction costs in copies or other formats.

Limitation of Personal Data Use or Disclosure:

 

In order for the Data Subject to exercise their right to limit the use or disclosure of personal data, while intending to continue using the services and products provided by the Controller, the user must express this in writing to the following email address: info@infinitybrands.mx. This written request must contain the following:

 

(i) The name of the data subject, address, and email address to communicate the response to their request.

 

(ii) Identity documents, such as voter ID, passport, military service card, or migration card, attached as a clear and legible image of both sides.

 

(iii) If represented by a third party, include the representative's identification and a power of attorney signed by two witnesses acting on behalf of the data subject, with clear and legible images attached.

 

(iv) The relationship held or currently held with the Controller.

 

(v) A clear and precise description of the data they wish to limit in its use or disclosure.

 

(vi) The letter must be addressed to the Controller and the Privacy Area of the Controller. The request will be sent to the email address of the Personal Data Area, info@infinitybrands.mx. Personal data that have fulfilled their purposes but cannot be canceled and/or deleted by law or contract will be blocked from the purposes they were subjected to until they can be deleted. During this period, personal data cannot be subject to processing beyond conservation and safeguarding.

Use of Cookies or Any Technology to Collect Information:

 

The Controller uses cookies on the website. Cookies are data files stored on the hard drive of the computer or electronic communications device of a Data Subject when browsing a website, allowing for the exchange of state information between the website and the Data Subject's browser. State information can reveal user authentication or preferences, as well as any data stored by the browser regarding the website. Cookies cannot be used to obtain data from your hard drive, email address, or any other private information, but solely to collect information about the behavior of the Data Subject when visiting the website. The installation, permanence, and existence of cookies on the User's computer depend solely on their will and can be removed from their computer at any time. Modifications to the Privacy Notice:

 

The Controller, as well as the Data Subject, acknowledge that this Privacy Notice has unlimited validity. However, the Controller will seek to keep the present Notice updated. The publication of modifications to the Privacy Notice will be generalized for all data subjects. Changes to the Privacy Notice will be communicated to the Data Subject through a notice on the Controller's Website.

Consent:

 

The Data Subject, before providing their personal data, expressed their consent explicitly with this Privacy Notice, which was made available to them prior to the delivery of such information on the website.

Revocation of Consent:

 

The Data Subject may revoke their consent at any time with this Privacy Notice and the Processing of their Personal Data. To revoke consent, the Data Subject must send a Request to the email address info@infinitybrands.mx, which must be in writing and meet the following requirements:

 

(i) Identity documents, including voter ID, passport, military service card, or Migration Card, attached as a clear and legible image of both sides.

 

(ii) If done through a representative, the representative's identification and a power of attorney signed by two witnesses acting on behalf of the Data Subject, with clear and legible images attached.

 

(iii) The relationship held or currently held with the Controller.

 

(iv) The letter must be addressed to the Controller and the Privacy Area of the Controller. The Controller will issue a response confirming the revocation of consent or provide reasoning based on the specific case, with the Controller having 15 days to issue this response. The deadlines will be counted from the moment the email enters our server, with the Controller issuing the respective Acknowledgment of Receipt of Request. The Request will not be valid in case of omission of the aforementioned requirements.

Internal Privacy Area:

 

The Data Subject may exercise their rights and make the consultations indicated in this document, as well as in the law, through the Privacy Area of the Controller to which the Requests indicated in this document and in the Law must be directed. The User must use the aforementioned email info@infinitybrands.mx to contact the Privacy Area. The head of the Privacy Area is Dieter Pfeffer.

For any questions or additional information, as well as to exercise different types of rights and procedures in addition to those indicated herein, the User can contact the National Institute for Transparency, Access to Information, and Personal Data Protection "INAI" at Telephone 800-835-4324 (toll-free) through the website www.ifai.org.mx.

Acceptance of Terms:

 

If you use the services of this site, it means you have read, understood, and accepted the terms stated above. If you do not agree with them, you should not provide any personal information.
